These Terms of Service govern your use of the Palmetto Print Works website, online store, products, digital products, and related services.

By visiting our website, purchasing a product, downloading a digital product, creating an account, or otherwise using our services, you agree to these Terms of Service.

Throughout these Terms, “Palmetto Print Works,” “we,” “us,” and “our” refer to Palmetto Print Works. “You” and “your” refer to the customer, website visitor, or user of our services.

1. Online Store Terms

You may use our website and services only for lawful purposes.

You may not use our products, website, digital files, or services in violation of any applicable law or regulation, or in any manner that could damage, disable, interfere with, or compromise the operation or security of the website or services.

You agree not to transmit malicious code, attempt unauthorized access, scrape or misuse website content, interfere with another customer’s use of the website, or use our services for fraudulent purposes.

2. Products and Services

Palmetto Print Works offers physical products, personalized products, made-to-order products, and digital products.

We make reasonable efforts to display product descriptions, photographs, colors, dimensions, features, and other information accurately. However, actual appearance may vary slightly due to display settings, materials, manufacturing processes, lighting, filament characteristics, production tolerances, or other factors.

Many physical products are created using additive manufacturing and similar production methods. Minor layer lines, texture variations, seam locations, surface differences, or small cosmetic variations may occur as a normal part of the manufacturing process and do not necessarily constitute a defect.

We reserve the right to modify, discontinue, limit, or update products or services at any time.

3. Personalized and Made-to-Order Products

Customers are responsible for reviewing all personalization information before submitting an order.

This includes, where applicable:

- Names and spelling
- Text
- Sizes
- Shapes
- Fonts
- Colors
- Layout selections
- Product options
- Other customer-provided information

Palmetto Print Works is not responsible for errors contained in personalization information submitted by the customer.

If we make an error during production, we will review the issue and provide an appropriate remedy in accordance with our Return & Refund Policy.

Because personalized and made-to-order products are produced specifically for the customer, they may not be eligible for return or cancellation after production begins.

4. Digital Products

Digital products are delivered electronically and do not include a physical product unless specifically stated in the product listing.

Digital purchases are for the purchaser’s permitted personal or commercial use only as described in the applicable product listing or license terms.

Unless expressly stated otherwise, purchasing a digital product does not transfer ownership of copyrights, trademarks, designs, artwork, source files, branding, or other intellectual property belonging to Palmetto Print Works.

Digital files may not be resold, redistributed, shared, uploaded for public distribution, sublicensed, or represented as the purchaser’s original work unless the product listing expressly grants that right.

Digital purchases are generally non-refundable after files have been delivered or made available for download, except as described in our Return & Refund Policy.

5. Orders

We reserve the right to accept, decline, cancel, or limit an order when reasonably necessary.

This may include situations involving:

- Suspected fraud
- Pricing or listing errors
- Product availability
- Production limitations
- Invalid or incomplete customer information
- Technical errors
- Orders that cannot reasonably be fulfilled

If we cancel an order after payment has been collected, an appropriate refund will be issued.

Submitting an order does not guarantee acceptance until the order has been successfully processed.

6. Pricing and Payment

Prices are shown in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time without prior notice.

The price charged for an order will generally be the price displayed at checkout when the order is submitted, subject to correction of obvious pricing or technical errors.

Applicable taxes, shipping charges, discounts, and other fees will be displayed at checkout when required.

Payment processing may be provided by Shopify and other third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method.

7. Shipping and Delivery

Physical orders are shipped according to our Shipping Policy.

Processing time and carrier transit time are separate.

Many Palmetto Print Works products are made to order and require production time before shipment.

Delivery dates and carrier transit times are estimates and are not guaranteed.

8. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, damaged products, personalized-product eligibility, digital-product refunds, and cancellations are governed by our Return & Refund Policy.

By placing an order, you acknowledge and agree to the policies applicable to the product you purchase.

9. Product Use and Safety

Customers are responsible for using products in a reasonable manner and for their intended purpose.

Products should not be modified, misused, subjected to unsafe conditions, or used for purposes for which they were not designed.

Certain 3D-printed materials may be affected by heat, prolonged sunlight, excessive force, chemicals, moisture, or other environmental conditions.

Customers are responsible for determining whether a product is suitable for their intended use.

Unless expressly stated otherwise, products are not represented as food-safe, medical-grade, child-safety-certified, or suitable for safety-critical applications.

10. Intellectual Property

All content made available through Palmetto Print Works, including product designs, photographs, graphics, logos, branding, artwork, text, digital files, downloadable materials, and other original content, is owned by or licensed to Palmetto Print Works unless otherwise stated.

Such content is protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, publish, modify, sell, sublicense, or commercially exploit our intellectual property except where we have expressly granted permission.

“Palmetto Print Works,” associated branding, logos, and original product designs may not be used without authorization.

11. User Content and Personalization Submissions

If you submit names, text, images, logos, designs, photographs, or other materials for personalization, you represent that you have the necessary rights or permission to use and provide those materials.

You remain responsible for the content you submit.

You grant Palmetto Print Works a limited right to use submitted materials solely as reasonably necessary to produce, fulfill, support, or resolve issues relating to your order.

We reserve the right to refuse personalization content that is unlawful, infringing, abusive, threatening, hateful, deceptive, or otherwise inappropriate.

12. Third-Party Services

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, applications, social media platforms, and other service providers.

We are not responsible for the availability, content, security, privacy practices, or operation of third-party services that we do not control.

Your use of third-party services may also be subject to their own terms and policies.

13. Errors, Inaccuracies, and Omissions

Occasionally, information on our website may contain typographical errors, inaccuracies, omissions, incorrect pricing, availability information, shipping information, or other mistakes.

We reserve the right to correct errors, update information, or cancel affected orders when reasonably necessary.

14. Prohibited Uses

You may not use our website, services, products, or content:

- For unlawful purposes
- To violate applicable laws or regulations
- To infringe intellectual-property rights
- To submit false or misleading information
- To transmit malicious software or code

To the fullest extent permitted by applicable law, Palmetto Print Works will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, services, or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Palmetto Print Works from claims, liabilities, losses, or expenses arising from your unlawful use of the services, violation of these Terms, infringement of another party’s rights, or misuse of materials submitted for personalization.

18. Privacy

Your submission and use of personal information through the store is governed by our Privacy Policy.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

These Terms remain effective unless terminated by you or Palmetto Print Works.

We may suspend or terminate access to the Services when reasonably necessary due to violations of these Terms, unlawful activity, fraud, abuse, or security concerns.

Any obligations or liabilities incurred before termination will survive termination where appropriate.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies posted on our website, constitute the agreement governing your use of the Services and purchases from Palmetto Print Works.

22. Governing Law

These Terms of Service and any separate agreements through which Palmetto Print Works provides services will be governed by applicable United States law and the laws of the State of South Carolina, without limiting any consumer rights that apply under mandatory law.

We may update these Terms of Service from time to time to reflect changes to our products, services, operations, legal requirements, or business practices.
